Privacy Policy

1. Overview

SocialNow is an AI-powered social media management app for Clover merchants, operated by Evidence Ventures, LLC (“Evidence Ventures,” “we,” “our,” or “us”). This Privacy Policy explains how we collect, use, store, and share information when you install and use SocialNow through the Clover App Market. By installing SocialNow, you agree to the practices described in this policy.

This policy complies with Clover's Developer Legal Guidelines and applicable data protection laws including, where applicable, the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR).

2. Information We Collect

When you install and use SocialNow, we collect the following categories of information:

  • Clover merchant data. Your merchant profile, business name, category, address, hours, and timezone, accessed via the Clover API once you authorize the app. This context is used to generate social content specific to your business.
  • Google Business data. Your Google Business Profile rating, review count, recent customer reviews, and business description, accessed via the Google Places API. This data enriches AI-generated drafts so content reflects your real-world reputation.
  • Social media credentials. OAuth access tokens for Instagram and Google Business Profile, used solely to publish approved content on your behalf. Tokens are stored encrypted and never shared.
  • Instagram performance data. Engagement and reach metrics on your own Instagram posts and professional account (such as likes, comments, reach, and impressions), accessed via the Instagram Graph API with your permission. We use this only to compute your private Visibility Score and to tailor content recommendations to what performs best for your business. It is shown only to you.
  • Content and draft data. AI-generated content drafts, post text, media asset references, scheduling preferences, publish history, and your conversation history with the SocialNow agent.
  • Account metadata. Your Clover merchant ID, merchant name, email address, and timezone.
  • Usage data. Logs of actions taken within SocialNow, including content generation requests, scheduling changes, and publishing events.

3. How We Use Your Information

We use the information we collect to:

  • Operate and provide the SocialNow service
  • Generate AI-powered social media content tailored to your business, category, and Google reputation context
  • Publish approved posts to Instagram and Google Business Profile on your behalf, only after you review and confirm each post
  • Schedule and queue posts for automatic publishing at times you choose
  • Improve the reliability, accuracy, and quality of AI-generated content
  • Comply with applicable legal obligations and Clover's developer policies

We do not use your data or your customers' data to train AI models for purposes unrelated to operating SocialNow. AI content generation is powered by Anthropic's Claude API; data sent to Anthropic is subject to Anthropic's privacy policy.

4. How We Share Your Information

We do not sell your data to advertisers, data brokers, or any other third parties. We share data only in the following limited circumstances:

  • Service providers. We share data with third-party vendors strictly necessary to operate the service — including Anthropic (AI content generation), Google (Places API enrichment), and Meta (Instagram publishing). These providers are contractually bound to use data only for service delivery.
  • Social platforms. When you approve and publish a post, its content is transmitted to the relevant platform (Instagram or Google Business Profile) via their official APIs. That content is then subject to each platform's own terms and privacy policy.
  • Legal compliance. We may disclose information if required by law, regulation, legal process, or governmental request.
  • Business transfers. In the event of a merger, acquisition, or sale of substantially all of our assets, your information may be transferred. We will provide notice prior to any such transfer and offer you an opportunity to opt out.

5. Data Retention

We retain your merchant data, content history, and social credentials for as long as your SocialNow account is active or as needed to provide the service. If you uninstall SocialNow, we will retain your data for up to 90 days to allow for account reactivation, after which it will be permanently deleted from our systems. You may request earlier deletion at any time by contacting us (see Section 7).

6. Security

We implement industry-standard technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. This includes encrypted data transmission (TLS/HTTPS), encrypted storage of social media access tokens, and strict access controls limiting who can access your data. In the event of a security breach affecting your personal data, we will notify you promptly and in accordance with applicable law.

7. Your Rights and Controls

You have the following rights regarding your data:

  • Access. You may request a copy of the personal data we hold about you and your account.
  • Correction. You may request correction of inaccurate or incomplete data.
  • Deletion. You may request deletion of your account data, content history, and social credentials by emailing privacy@counterpilot.ai.
  • Revoke Clover access. You can uninstall SocialNow from your Clover dashboard at any time, which immediately revokes our API access to your Clover data.
  • Revoke social account access. You can disconnect any social media account within SocialNow or directly through each platform's settings, which immediately revokes our publishing access.
  • Content control. No post is published without your explicit review and approval. You control all publishing decisions.

Instagram data deletion and app removal

If you remove SocialNow from your Instagram account (“deauthorize” the app), we automatically and permanently delete the Instagram access tokens and connected-account data associated with that account from our systems. You can delete your Instagram data at any time by any of the following:

  • Disconnect Instagram within SocialNow, or remove the app from your Instagram or Facebook settings. This triggers automatic deletion through our deauthorization callback.
  • Submit a data deletion request through Instagram. We process the deletion and return a confirmation code together with a status page where you can verify that deletion is complete.
  • Email privacy@counterpilot.ai to request deletion of any data associated with your account.

8. Children's Privacy

SocialNow is designed for use by business merchants and is not directed at individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us immediately.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the “Last updated” date at the top of this page and, where appropriate, by providing notice through the Clover dashboard or via email. Your continued use of SocialNow after changes take effect constitutes your acceptance of the updated policy.
